Nainital. The Uttarakhand High Court has granted relief to Shruti Negi from Kordwar for allegedly using objectionable language against followers of Hindu religion while standing at Mallital Flats ground in Nainital. The court has asked Mallital Kotwali on what basis they have imposed sections 153A and 295A of IPC against the woman.
The court has also sought an immediate stay on the ongoing investigation against the woman. Shruti’s lawyer has told the court that she belongs to this religion and was hurt by it. His speech of expression cannot be denied as being a constitutional right. The police had issued non-bailable warrants against Swati Negi after hindu organisations lodged an FIR at Mallital Kotwali police station alleging that the blog was an “insult to Hindus”.
Swati Negi had challenged this action of the police in the High Court and demanded that the FIR lodged against her be quashed. The hearing was held on Tuesday in a single bench of Justice Ravindra Maithani. During the hearing, the court verbally made strong observations on the police proceedings and stayed the investigation of the FIR and asked the police to respond.
On this basis, the young woman will not have to face any problem like detention or arrest. The next hearing in the case will be on May 12.
