High Court told DFO in the matter of removal of encroachment – We do not find your intention right

The court ordered PCCF to investigate and submit a report, the next hearing will be on October 12.

Nainital. The Uttarakhand High Court expressed strong displeasure over the DFO giving 15 days time to the encroachers on a PIL filed regarding encroachment on the land of National Highway, Nagla and GB Pant University of Agriculture and Technology in Pantnagar of Udham Singh Nagar district.
The court has personally summoned DFO Himanshu Bagri and asked him to explain that when the time to remove encroachment under the Forest Act is 10 days, then how the encroachers were given 15 days time. We don’t understand your intentions. The court has also asked PCCF to investigate and submit a report. The next hearing of the case will be on October 12.
On Wednesday, during the hearing in the division bench of Chief Justice Vipin Sanghi and Justice Rakesh Thapliyal, District Magistrate Uday Pratap Singh appeared in the court. He said that complete preparations have been made to remove the encroachment. Encroachment has been removed from many places. Wherever encroachment has taken place, eviction notices have been given to those people under the PP Act.
The court has asked the DM to take immediate action on the cases in which eviction orders have been issued. No date should be extended in the cases which are on date. Along with this, instructions were also given to present the report of action taken on the encroachment on the land of Pantnagar University and National Highway. Petitioner Amit Pandey submitted an application saying that in the year 2021, the court had given orders to remove the encroachment. Once the encroachment is removed there, encroachment is being done again.
